On the 25th April, just two minutes after the day had begun (Central European Time), Reddit Supervisor Viad used his Wick-ban-permissions to remove Nf19 (full username: nf19_1) from SimDemocracy upon request from OHS Agent Notcommunist.
The banning was received positively by #general with many users expressing happiness due to the (alleged) TIDE alt finally having been banned.
Despite multiple sources indicating that the DoJ did investigate the case and had come to the conclusion that Nf19 probably was a TIDE member/alt, no Judge had approved an arrest warrant or similar at that point. Similarly, no Criminal Complaint had been officially filed at that point.
Due to these circumstances mbh, who deemed the banning to be unlawful, requested the release of Nf19 utilizing the new Habeas Corpus laws at 12:42 (Central European Time). This request was approved by Judge Ed who shared mbh’s opinion that the banning was unlawful. Additionally, ban permissions have been removed from the Reddit Supervisor role since.
I asked President Democracyforyou some questions regarding the case:
Q: Can you describe the series of events from the perspective of the government?
A: They were identified as being a member of Tide. The DOJ investigated. A ban was issued. A repeal was launched. Reports say the repeal was successful - simplified version.
Q: Was Judge Ed right in ordering the release of Nf19?
A: Judges are within their right to do that and I believe the DoJ will make the appropriate decision on how best to move forward.
Q: How will the OHS handle the situation if Nf19 attempts to rejoin the server? Will they be let back in?
A: The government will follow the law and the OHS will abide by the law.
Q: If you deem the banning to have been unlawful, who is to blame for it? Viad of Notcom?
A: If [there] was a crime committed, then the responsible party/parties will be held accountable.
Q: If you deem the banning to have been unlawful, will disciplinary measures be taken?
A: In accordance with the law, operating procedure, and what is necessary to correct and prevent such behavior.
